Terms of Service - Aves ID

These terms apply to your use of the Aves ID mobile application. By installing or using the app, you agree to all these terms. If you don't agree, please don't use the app.

1. Licence to use the app

Offline Apps grants you a personal, non-exclusive, non-transferable, revocable licence to install and use Aves ID on devices you own or control, for your own non-commercial use.

You may not:

• Copy, modify, translate or create derivative works of the app or any part of it.
• Reverse engineer, decompile or disassemble the app, or attempt to extract its source code, machine learning models, databases or assets, except to the extent this restriction is prohibited by applicable law.
• Redistribute, sell, rent, sublicense or publish the app or its content, in whole or in part.
• Remove or obscure any copyright, trademark or other proprietary notices.
• Use the app's content to train machine learning models or to build a competing product or service.
• Use automated means to extract data from the app.

2. Intellectual property

All content in Aves ID is owned by Offline Apps or used under licence, and is protected by copyright and other intellectual property laws. This includes:

• The bird identification models. The classification model was developed specifically for this app and is the property of Offline Apps.
• Written content. Species descriptions, observation tips, facts, and all other text, in every language in which it is provided.
• Illustrations and graphics. Achievement artwork and icons were created by Offline Apps. Bird illustrations were created with AI tools and substantial human editing and input. All illustrations, graphics and artwork are considered proprietary content of the app.
• The app itself. Source code, design, user interface, structure and layout.
• Branding. The name "Aves ID", "Offline Apps", and associated logos.

Nothing in these terms transfers any ownership to you. Using the app does not give you any rights to its content beyond the limited licence in Section 2. However, you are permitted to share screenshots of the app, your personal observations, and achievements on social media for non-commercial purposes.

Third-party components. The app uses a pre-trained object detection model (YOLOX, licensed under Apache License 2.0, © Megvii Inc.) to locate birds within photos before classification. Other open-source components are listed in the app under Settings → Licences. Map data is provided by OpenFreeMap and its upstream sources.

3. Your content

Photos, notes and diary entries you create remain yours. They are stored locally on your device and we never receive them, so we make no claim to them and cannot access, use or publish them.

Because this content stays on your device, we have no ability to review, moderate or remove it. You are solely responsible for what you photograph, write or store in the app, and for ensuring it complies with applicable law - including laws on obscene, illegal or harmful content, and the privacy and rights of anyone who appears in your photos. We are not liable for any content you create or store using the app.

4. Subscriptions

What's free. The full field guide, a limited number of daily identifications, and your first diary entries are available at no cost.

Aves ID PRO. A paid subscription that unlocks unlimited identifications and unlimited diary entries. It is offered as a monthly or yearly plan.

Billing. All payments are handled by Google Play. By subscribing, you confirm that you are authorized to make the purchase and, if you are under 18, that you have obtained your parent's or guardian's consent. Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before renewal. Prices are shown in the app before purchase and may vary by region.

Cancellation. You can cancel your subscription at any time through Google Play (Settings → Payments & subscriptions). Cancellation stops future renewals; you keep PRO access until the end of the period you've already paid for.

Refunds. Refunds are handled by Google Play under their refund policy. We are not able to process refunds directly.

Changes to pricing or features. We may change subscription prices or what's included in PRO. Existing subscribers will be notified through Google Play before any price change takes effect, and you may cancel if you don't accept it.

Free trial. New users get full PRO access for 7 days after installing the app, at no cost and without providing payment details. When the trial ends, the app automatically reverts to the free tier unless you choose to subscribe. You will not be charged unless you actively purchase a subscription.

5. Accuracy and intended use

Aves ID identifies birds using machine learning. Identifications are suggestions, not certainties. The app may be wrong, including confidently wrong, particularly with poor image quality, unusual angles, juvenile or moulting birds, hybrids, or species outside its current database.

Aves ID is intended as a companion for recreational birdwatching. It is not suitable for:

• scientific research, surveys or official records without independent verification;
• conservation, legal, regulatory or commercial decisions;
• determining whether a bird or its habitat is protected under any law;
• any situation where an incorrect identification could cause harm or loss.

Always verify important identifications against authoritative sources or with a qualified ornithologist.

The species information in the app is provided for general interest. While we take care to keep it accurate, we do not warrant that it is complete, current or error-free - taxonomy, conservation status and distribution change over time.

6. Your responsibilities

When using Aves ID, you are responsible for your own safety and for respecting the birds and their environment. In particular:

• follow local laws on access to land, protected areas and wildlife disturbance;
• do not disturb nesting birds or approach wildlife in a way that causes stress;
• take reasonable care of your own safety in the field.

We are not responsible for anything that happens while you are using the app.

7. Availability

We aim to keep the app working, but we do not guarantee uninterrupted availability. Features that require a connection to a third-party service - purchasing subscriptions, maps and address lookup - may be unavailable at times for reasons out of scope of Offline Apps.

We may update, change or discontinue the app or any of its features. If we discontinue the app entirely, we will give reasonable notice where practicable, and any active subscription will run to the end of its paid period or be refunded through Google Play. Discontinuing the app does not affect the data already stored on your device.

8. Liability

The app is provided "as is", to the extent permitted by law. We are not liable for indirect or consequential loss, loss of data, or loss arising from reliance on an identification or on species information in the app.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded under Dutch or applicable EU consumer law. If you are a consumer, your statutory rights are not affected by these terms.

Where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the claim arose.

9. Privacy

Our handling of data is described in our Privacy Policy, which forms part of these terms.

10. Changes to these terms

We may update these terms. The date at the top will change, and material changes will be noted in the app's release notes on Google Play. Continuing to use the app after an update means you accept the revised terms.

11. Governing law

These terms are governed by the laws of the Netherlands. If you are a consumer resident in the EU, you also benefit from the mandatory consumer protection provisions of your country of residence, and may bring proceedings there.

If any part of these terms is found to be invalid or unenforceable, the remaining parts stay in effect.
